One-time FBI Staff Member Alleges Improper Firing Because of LGBTQ+ Banner Presence

An experienced FBI operative has initiated legal action stating he was dismissed for having an LGBTQ+ banner in his office space.

As per the plaintiff, who was employed with the bureau over a decade and a half, the firing earlier this year is being described as “illegal and discriminatory”.

Court Case Claims Free Speech Violations

The legal filing states that the FBI violated the plaintiff’s constitutional rights and took punitive steps toward him because of expressing legally safeguarded communication.

Maltinsky is seeking a court order to reinstate his position with the FBI.

The comprehensive lawsuit, filed in federal court in Washington, D.C., alleges that the employee was dismissed from the Quantico facility in October because of earlier showing the Pride symbol at his workstation.

According to the filing, the Pride flag was given to Maltinsky in recognition of his contributions to promote the agency’s inclusion programs.

“From a young age, all I have wanted to do is serve the United States and safeguard the nation’s safety alongside the brilliant and dedicated personnel at the agency,” stated the former employee.

He continued, I showed that banner – that previously was displayed at the Los Angeles office – not as a political statement, but as a representation of diversity, togetherness and fair treatment.

These principles that helped build the bureau effective. Today it has become where employees like me face discrimination. I am convinced I was dismissed not due to my identity, but due to my being: an openly gay individual,” he said.

Abrupt Firing Just ahead of Finish

Earlier this year, Maltinsky gained admission to the FBI special agent training academy at the FBI facility, until his “abrupt dismissal only weeks prior to graduation”.

The lawsuit further alleges that eventually after the presidential inauguration, an colleague reported a complaint to his manager regarding the display of the rainbow banner.

To be safe, Maltinsky requested that the legal advisor for the local bureau review whether the exhibition of the Progress Pride flag was allowed,” the filing noted.

It further mentioned, The legal officer informed the plaintiff that exhibiting of the flag was not against any policy, rule, or regulation.”

Notice of Firing

Nevertheless, on 1 October, the employee was notified of his termination.

In correspondence referenced in the complaint, bureau chief Kash Patel wrote, “I have determined that you used improper judgment with an inappropriate display of a partisan emblem in your office while previously assigned in Los Angeles.

In accordance with federal law of the United States Constitution, and regulations of the nation, your position with the FBI is hereby terminated.”

In a statement issued on Wednesday, his legal representative the attorney remarked, The government’s illegal termination is a component of a broader effort to purge public offices of employees that possess alternative perspectives, or are from underrepresented communities, or who dare challenge bias.

This battle is not only for him, but about securing the entitlements and freedoms of all public servants.”

The bureau declined to comment on the lawsuit.

Maltinsky’s lawsuit follows a separate case submitted earlier by ex- top agency personnel who said they had been improperly dismissed.

They alleged that the director said he had been directed by the administration to dismiss any official participating in a probe into Trump.

Additionally, the bureau fired a long-serving employee earlier this month subsequent to the director allegedly grew upset due to accounts that the agency head had taken a government jet to go to a match where his girlfriend performed the national anthem.

Steven Palmer, an agency staffer for many years, was fired as head of the bureau’s emergency unit, that handles major security threats and the agency’s jet fleet.
